General Information

These data protection notices inform you about how your personal data is processed in connection with the use of the website https://www.elisenhof-muenchen.com (the “Website”).

Please note that in certain cases (e.g. due to tax regulations), providing personal data may be required by law or by contractual arrangements (e.g. information about the contracting party). For example, it may be necessary for the conclusion of a contract that the data subject provides their personal data so that their request (e.g. an order) can be processed. An obligation to provide personal data therefore arises in particular when entering into a contract. If, in such a case, no personal data is provided, the contract cannot be concluded.

Before providing personal data, you may contact us. We will then clarify whether providing the requested personal data is legally or contractually required, or necessary for concluding a contract, and what the consequences of not providing such data would be.

Processing of Personal Data; Purposes of Processing

a) Log Files and Informational Use of the Website

Storage in log files is carried out to ensure the functionality of the website. In addition, the data helps us to technically optimize the website and to ensure the security of our information technology systems. Data analysis for marketing purposes does not take place in this context.

When you use the website purely for informational purposes, i.e. if you do not actively transmit information to us, we generally do not collect any personal data, with the exception of data that your browser automatically transmits to enable you to visit the website. This includes, for example:

  • IP address;
  • Date and time of access, including duration of visit;
  • Data volume transferred in each case;
  • Browser used;
  • Operating system used;
  • The website from which you were referred to us (referrer);
  • Websites that are accessed by the user’s system via our website

We generally do not assign this data to specific individuals. The above-mentioned processing of data takes place solely for the purpose of enabling use of the website (connection establishment; technical session management). Insofar as the processing of the aforementioned data constitutes personal data, such processing is based on Article 6 (1) sentence 1 lit. f GDPR (legitimate interest; the legitimate interest follows from the aforementioned purpose — enabling the provision and retrieval of the website).

b) Contact

If you contact us (e.g. by email or via a contact form on the website), the data you provide in this context will be used to process your inquiry. In the case of contact via email, this generally includes the following data:

  • Name
  • Email address
  • Content of the message
  • Websites that are accessed by the user’s system via our website

The above data is used solely to process your inquiry.

The legal basis for processing the aforementioned personal data is, depending on the specific case, either Article 6 (1) sentence 1 lit. b GDPR (contract or pre-contractual measures) or Article 6 (1) sentence 1 lit. f GDPR (legitimate interests; the legitimate interest arises from the fact that only by processing the data can the user’s request (e.g. responding to inquiries) be carried out) or Article 6 (1) sentence 1 lit. a GDPR (consent). For any data transfers to third parties in this context, see also Section 3 below.

c) Cookies

When you visit our website, we may use cookies and similar technologies. Cookies are small text files stored in your browser’s memory.

We use technically necessary cookies to enable navigation, basic functionality, and website security. These cookies do not collect information for marketing purposes or track which websites you visit. The legal basis for these technically required cookies is Article 6 (1) sentence 1 lit. f GDPR (legitimate interest; in particular, session management and website security).

If we use non-essential cookies, we will always obtain your prior consent via our cookie management tool. Without consent, these cookies will not be used. The legal basis for processing such cookies is Article 6 (1) sentence 1 lit. a GDPR (consent).

Common browsers can usually be configured so that no cookies are stored. However, disabling cookies may result in not being able to use all functions of our website (fully or without disruption).

Source of Your Personal Data

We primarily process personal data that we have received directly from you. Should we exceptionally process personal data that we have not received directly from you, this concerns data that we have lawfully obtained from publicly accessible sources (e.g. the Internet, press, commercial and association registers) or that have been lawfully provided to us by third parties.

Disclosure of Personal Data

Personal data collected in connection with the use of the website will — unless otherwise stated in these data protection notices — not be disclosed or transmitted to third parties without your consent.

We may disclose your personal data to third parties if we are legally obliged to do so (e.g. upon request by a court or law enforcement authority). The legal basis for such data processing is Article 6 (1) sentence 1 lit. c GDPR (legal obligation).

We may also engage (technical) service providers who process personal data on our behalf (e.g. IT service providers; see also below). These service providers process the respective personal data exclusively according to our instructions (processors; Article 28 GDPR).

We may also transmit or share data with selected partner(s) or have such partners process data on our behalf, in particular when you contact us in connection with the website (e.g. if your inquiry relates to topics concerning our partners who market or provide services in relation to the properties described on the website).

The legal basis for such data processing is generally Article 6 (1) sentence 1 lit. b GDPR (contract or pre-contractual measures), particularly in cases of contract initiation; depending on the case, Article 6 (1) sentence 1 lit. a GDPR (consent) or Article 6 (1) sentence 1 lit. f GDPR (legitimate interest; the legitimate interest arises from the fact that we can only process your request by processing the relevant data and that all parties involved have an interest in having the respective request answered or processed) may also serve as the legal basis for such transfers.

Please contact us if you have questions regarding our partners.

Duration of Storage of Personal Data

Unless otherwise stated, your personal data will only be stored for as long as necessary to process your inquiry or fulfill the relevant purpose. Thereafter, data will only be retained as required by legal retention obligations. Once such periods expire, the data will be deleted.

Your Rights

You have the right to request information about the personal data we hold about you. Where the legal requirements are met, you also have the right to request rectification, deletion or restriction of processing of the respective personal data, the right to object to the processing of your personal data, as well as the right to receive the personal data concerning you that you have provided to us in a structured, commonly used and machine-readable format (you may transmit this data to other entities or have it transmitted by us).

If you have given consent to the use of personal data, you may withdraw this consent at any time with effect for the future. If you believe that the processing of personal data concerning you by us violates applicable data protection law, you may lodge a complaint with the competent data protection supervisory authority.

Data Security

We maintain up-to-date technical measures to ensure data security, in particular to protect your personal data against risks during data transmission and against unauthorized access by third parties. These measures are regularly reviewed and updated to reflect current technical standards.
